I was talking to a potential client today and it was involving a car accident with disputed liability, whereas an intersection accident. So it’s a 50/50 shot as to who potentially is liable or responsible for the accident.

This potential client hired a lawyer at the time of the accident. The accident occurred about five, six, seven months ago. He went through with the case, went through a treatment, demand was sent and the insurance company denied the claim. Not uncommon, I mean, it happens, but as a trial lawyer or a litigation lawyer like myself, if something like that happens, not a big deal, because we recommend litigation, we recommend a lawsuit and we push it forward. But in this situation, unfortunate for the client, she hired a lawyer that does not go to court.

So, after the demand, after that denial, the lawyer told the client that I have to withdraw from the case – I don’t go to court. So, now the client is stuck on the street with no recourse but to now try to find a lawyer six, seven, eight, nine, 10 months into a case, which is certainly very challenging to get a lawyer at that stage of the game.

Now, at the end of the day, why I told the client is, look, would you go to a doctor that doesn’t do surgery? Absolutely not. So why would you go to a lawyer that doesn’t go to court? It just doesn’t make sense to me.
